Lawsuit Filed!
Below is commentary from Timonthy Monet, who filed a lawsuit challenging the claim of over 50% petitions received in Lyon Township.
Now that a lawsuit has been filed and received we are awaiting a hearing date from the Michigan Tax Tribunal. This could takes a few weeks or a few months to get on their docket.
After review of the petition there is a chance that the Tribunal will move this legal challenge to the Circuit Courts. The State of Michigan has granted more authority to the Tax Tribunal in the past decade to resolve legal challenges brought forth regarding special assessments…but that isn’t a guarantee that they will hear our case. If our case is moved to Circuit Court, we will move forward in a timely manner.
The best scenario is that a summary judgment will be entered in our favor to effectively ‘force’ the Lyon Township Board to proceed with a formal review of all petitions as to there validity to obtain the necessary 50.1% they need to proceed. If that can happen, prior resolutions will be null and void and they can only proceed within the Statutes dictated by PA188.
